Welcome to AvenCheer Technologies (“Company”, “we”, “our”, “us”). By accessing or using our platform, website, mobile interface, or any services that allow users to submit voice notes, videos, or other cheer expressions (“Services”), you agree to these Terms & Conditions.
1. Eligibility
By using our Services, you confirm that you are 18 years or older or have parental consent, are legally capable of entering into a binding agreement, and are submitting content that you own or have rights to share.
2. User-Generated Content
You may upload or record voice messages, selfie videos, cheer content, and other forms of digital expression. By submitting content, you grant Cheer Stadium Technologies a worldwide, royalty-free, transferable license to process, moderate, mix, broadcast, display, reproduce, and distribute your content in connection with stadium playback, promotional use, and service functionality.
3. Content Moderation
All content may be processed through automated and/or human moderation. We may reject or remove content that is offensive, harmful, illegal, infringes rights, or violates stadium, broadcaster, or partner rules. Our moderation decisions are final.
4. No Guarantee of Stadium/Event Playback
Submitting content does not guarantee stadium/event display, audio playback, or inclusion in any broadcast. Playback is subject to moderation results, technical constraints, and partner policies.
5. Prohibited Use
You agree not to submit illegal or harmful content, bypass moderation, hack or disrupt our systems, impersonate others, or violate any local laws, stadium regulations, or broadcast standards.
6. Intellectual Property
All technology, software, design, trademarks, and processes used in the platform, including our patent-pending system, belong exclusively to Cheer Stadium Technologies. You may not copy, modify, distribute, or reverse engineer any part of the platform.
7. Data & Privacy
Your data may be stored, processed, and used to operate and improve the Services, and to comply with law. Personal information is handled according to our Privacy Policy.
8. Third-Party Partners & Stadium/event Rights
Events, stadiums/events, broadcasters, or partner organizations may approve or reject content and impose additional rules. You agree to comply with all applicable partner policies.
9. Service Availability
We may modify, suspend, or discontinue the Services at any time. We are not liable for delays, interruptions, or failures due to technical, operational, or partner-related reasons.
10. Limitation of Liability
To the maximum extent permitted by law, AvenCheer Technologies is not responsible for any indirect, incidental, or consequential damages arising from your use or inability to use the Services. You use the platform at your own risk.
11. Indemnification
You agree to indemnify and hold harmless AvenCheer Technologies from any claims arising from your content, your use of the Services, or your breach of these Terms.
12. Changes to Terms
We may update these Terms periodically. Continued use of the Services after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
